The wife of a Grammy-winning sound engineer who was killed by police in January has filed a lawsuit against the city of Nashville and a police officer. The suit alleges that Officer Ashley Coon used excessive and unreasonable force when he shot and killed Mark Capps while trying to serve a warrant.

Capps’ wife filed a lawsuit against the city of Nashville and Police Officer Ashley Coon on Monday, Oct. 30, claiming that Coon used “excessive, unreasonable force by shooting and killing Capps when he was not posing an active threat of imminent harm.

“We have not been served with the Capps lawsuit and have not reviewed or investigated the allegations,” she wrote in an email.Carjacking call led police to chief’s son who was wanted in officers’ shooting. Tara Capps and her daughter, McKenzie Acuff, went to their local police precinct for help.

“Nothing in Lancaster’s statements or tone indicated any fear that going to the Capps’s house to take him into custody would expose Lancaster to a likelihood of being injured or killed,” states the lawsuit, which was filed in federal court in the Middle District of Tennessee.
