Clinton's attorney's have filed a motion to dismiss the case against her, arguing that the statute of limitations has expired.

This week, both Clinton and the chairman of her 2016 presidential campaign John Podesta, who is also named as a defendant in the suit, filed motions to dismiss Trump's case, arguing that the statute of limitations on the former president's claims has expired.

The suit, which was filed in March, is seeking a jury trial and compensatory damages of at least $24 million, which it argues Trump has lost as a result of the defendants' actions. "One doesn't have to be a lawyer or a judge to ask the question: Why didn't the plaintiff file the suit years ago?" McAuliffe said.
