The Elizabeth Holmes trial: The prosecution ends with a haymaker
After 10 weeks, the prosecution has rested its case against Elizabeth Holmes. Over the course of 29 witnesses, the government laid out in painstaking detail how the 37-year-old entrepreneur misled investors in Theranos, her failed blood-testing startup. On Friday, her attorneys began to argue their case, though there's still no indication of whether Holmes will take the stand.
Based on what I've heard these past months, it seems to me that the United States has indeed made its case against Holmes. Prosecutors presented four themes — each hammered out with steady repetition, relying on a diverse group of witnesses — that should convince jurors that Holmes is guilty of bilking her investors.
But that ploy isn't likely to fly, for a very simple reason: Witness after witness testified that Holmes, and only Holmes, was firmly in control of Theranos. She owned a majority stake, served as its CEO, and had the final say in all important decisions. If she was somehow under the sway of Balwani — the so-called Svengali defense — her attorneys never once mentioned it during the government's case. From start to finish, Holmes was the one calling the shots.
