Starr County District Attorney Gocha Allen Ramirez said in a statement Sunday that 'it is clear that Ms. Herrera cannot and should not be prosecuted for the allegation against her' under Texas law.
A district attorney in Texas said Sunday that a woman who was arrested on a murder charge related to a self-induced abortion will not face prosecution.
"Although with this dismissal Ms. Herrera will not face prosecution for this incident, it is clear to me that the events leading up to this indictment have taken a toll on Ms. Herrera and her family," Ramirez's statement continued."To ignore this fact would be shortsighted. The issues surrounding this matter are clearly contentious, however based on Texas law and the facts presented, it is not a criminal matter.
"It is murder in Texas to take steps that terminate a fetus, but when a medical provider does it, it can't be prosecuted" due to U.S. Supreme Court rulings upholding the constitutionality of abortion, Vladeck said. Medication abortions are not considered self-induced under federal Food and Drug Administration regulations, Vladeck said.
"We don't yet know all the details surrounding this tragic event," said Rockie Gonzales, founder and board chair of the organization.
