Longoria and Cathy Morgan, a volunteer deputy registrar in Williamson and Travis Counties, argue the new penalties chill their protected speech, according to the motion filed in U.S. district court in the Western District of Texas. They asked the judge to block the provision by Feb. 14, four days before the deadline to request a mail ballot application for the upcoming primary election.

The Texas attorney general’s office did not immediately respond to a request for comment. Nor did Sen. Bryan Hughes, a Mineola Republican who authored the law, known as Senate Bill 1. Texas is one of 16 states nationwide that limit who can vote by mail, instead of opening it to everyone, according toAbsentee voters in Texas must be at least 65 years old, sick or disabled, out of the country on election day or in jail.

“I’m responsible for enabling the county’s millions of voters to exercise their right to cast a lawful ballot, many of whom face obstacles to voting in person due to illness, disability, or age,” she said in a statement. “S.B. 1 subjects me to criminal prosecution for encouraging eligible voters to vote by mail so they may participate in our democracy – an option they have under Texas law.”
