The U.S. Senate did something rare late on Wednesday: It unanimously confirmed one of President Joe Biden's judicial nominees.
The Senate on a voice vote unanimously approved elevating U.S. Magistrate Judge Matthew Brookman to a U.S. district court judgeship in the Southern District of Indiana, a state with two Republican senators.
By comparison, 26 of Republican President Donald Trump's 92 appointments at this point in his presidency received voice votes, according to data collected by the conservative Heritage Foundation. The Senate Judiciary Committee has maintained a custom of requiring senators to return "blue slips," named for the color of the paper forms, supporting district court nominees from their home states for them to advance.
Progressive groups like Demand Justice and the American Constitution Society have argued that maintaining the "blue slip" tradition has allowed Republicans to obstruct Biden from nominating new judges in their states to fill vacancies.
