The Supreme Court has upheld the power of city mayors to issue formal charges and preventive suspension orders against erring city employees.
In a 13-page decision, the high court granted the petition filed by Senator Sherwin Gatchalian when he was still Valenzuela City mayor assailing the ruling of the Civil Service Commission and the Court of Appeals that voided a formal charge for sexual harassment and order of preventive suspension against a city records officer.
In March 2012, the Office of the City Mayor issued a formal charge for sexual harassment and an order of preventive suspension against Raymond Urrutia, the records officer, for the sexual harassment of an on-the-job trainee or student. In 2015, the CA ruled that the CSC did not err in its ruling and found that Gatchalian had no power to issue the formal charge and preventive suspension order.
“There is legal basis for not reinstating Urrutia to his former position since Gatchalian, through the CODI, had jurisdiction and authority to try the Sexual Harassment case against Urrutia,” it added.
