Rather than establish the right to review instructional material, which generally already exists, SB 1211 creates a cumbersome disclosure regimen that is pregnant with unintended consequences.Every school in the state would have to have a public website on which every scrap of written or video material used in any classroom is listed. The entries would have to be sortable by grade, course and teacher.
The enforcement mechanism is also administratively tedious. A complaint can be made by a parent, but not just a parent. The superintendent of public instruction, attorney general and the county attorney can also file a complaint. If the complainant remains dissatisfied, a case can be filed in superior court. If the complainant prevails, attorney fees are to be awarded.The bill is being pushed by the Goldwater Institute, which should be more respectful of the public choice theory of economics than is reflected in this cumbersome lattice. The theory holds that public sector politicians and bureaucrats respond to incentives, just as private sector investors, producers and consumers do.
