ET is breaking down everything that has come to light about the tragic on-set shooting.

"The reason why I'm going to remand you is you are now convicted, and this is a death," the judge said."This is criminal negligence, but it's still death and so, deputies you are going to take her into custody." But nearly week after Baldwin waived arraignment, a judge reassignment occurred on Feb. 6. This move triggered the First Judicial District Court to cancel the Aug. 6 jury selection date, thus canceling the trial date.
"With no actual corroboration or evidence? And the state won’t identify the person?" Bowles added."This is a throwback to the secret, star chamber prosecutions in England in the 15th century that were abolished. Like everything else with the state’s case and investigation, it's full of sound and fury, but signifying nothing."
"There are no words to convey my shock and sadness regarding the tragic accident that took the life of Halyna Hutchins, a wife, mother and deeply admired colleague of ours," he wrote."I'm fully cooperating with the police investigation to address how this tragedy occurred and I am in touch with her husband, offering my support to him and his family."Per the affidavit, the assistant director did not know the prop gun was loaded with live rounds.
That statement noted the production team will"remain in close touch with Halyna's family and commend the strength they show in the face of unspeakable tragedy." However, when Baldwin was asked if he thought the movie would resume production, he said, "No, I don't." Oct. 25, 2021, the assistant director was previously the subject of complaints on the set of two productions in 2019.
Svetnoy explained how he'd worked with Hutchins on previous films, and says he was"standing shoulder-to-shoulder with Halyna during this fatal shot that took her life." The crew member went on to slam the producers of the film for not having"professionals" working on set.Firearms expert Steve Wolf provided insight into how an incident like this could occur.
"We know Hannah did not put the live rounds in that box, we know the live rounds shouldn't have been in that box, but they were... There is no purpose for a live round on this set. Zero. Hannah made that clear," he said."There was no reason for there to be live rounds, she didn't have live rounds, she didn't purchase any of this ammunition. This ammunition was purchased by other people, production.
"I have been overwhelmed by the love and support," he continues."My thoughts are with all who knew and loved Halyna."took to Instagram to share a series In a separate statement, Matthew Hutchins told ET,"We have reached a settlement, subject to court approval, for our wrongful death case against the producers of Rust including Alec Baldwin and Rust Movie Productions, LLC. As part of that settlement, our case will be dismissed.", which I will now executive produce, will resume with all the original principal players on board, in January 2023. I have no interest in engaging in recriminations or attribution of blame .
Andrea Reeb, the special prosecutor appointed by the District Attorney to the case, added,"If any one of these three people -- Alec Baldwin, Hannah Gutierrez-Reed or David Halls -- had done their job, Halyna Hutchins would be alive today. It’s that simple. The evidence clearly shows a pattern of criminal disregard for safety on the film set. In New Mexico, there is no room for film sets that don’t take our state’s commitment to gun safety and public safety seriously.
"In order to avoid further litigious distractions by Mr. Baldwin and his attorneys, the District Attorney and the special prosecutor have removed the firearm enhancement to the involuntary manslaughter charges in the death of Halyna Hutchins on the 'Rust' film set. The prosecution's priority is securing justice, not securing billable hours for big-city attorneys,” New Mexico First Judicial District Attorney spokesperson Heather Brewer said in a statement.
As part of the settlement, which is still pending approval, the April 2022 citation will be downgraded from"willful-serious" to"serious." In a statement, the production company's attorney, Melina Spadone, said,"We are pleased to have entered into an agreement with OHSB, subject to approval, which downgrades the citation and reduces penalties."
In a statement to ET, special prosecutors Kari Morrissey and Jason Lewis explained why they decided to drop the charges against Baldwin. "I owe everything I have to this woman," Baldwin wrote in his caption to an Instagram post of the couple,"and to you, Luke," which is in reference to his lawyer, Luke Nikas.to a settlement stemming from a wrongful death lawsuit filed against Baldwin on behalf of Hutchins' husband, Matthew Hutchins, and their son, Andros.
Prosecutors claimed that, on or about Oct. 21, 2021, in Santa Fe County, New Mexico, Gutierrez-Reed"did transfer narcotics to another person with the intent to prevent the apprehension, prosecution or conviction of herself, and the highest crime was a fourth degree felony." As for the identity of the witness, prosecutors are requesting that the court order Gutierrez-Reed, her attorney and their investigating team from releasing the identity of the witness, claiming the witness has concerns that they may be subject to harassment by the media if their identity is made public.She formally entered a not guilty plea on Aug. 9 2023 in the Santa Fe, New Mexico, First Judicial District Court.
The docs state that Baldwin is seeking a speedy trial to"minimize public vilification and suspicion" and to"avoid the hazards of proving his innocence that often arise after a lengthy delay in prosecution."in Baldwin's defense saying it wasn't his responsibility to know whether or not the gun he was holding was safe.
