In its response on Monday to New York’s motion, the New Jersey Attorney General’s office argued that the compact between the two states made in 1953 was silent on whether either state could walk away from their agreement. Based on its sovereign rights, it said it had the power to leave. At the same time, New Jersey claimed New York was late to the game, pointing out in its brief that James did not head to court until years after New Jersey enacted a law to withdraw from the commission in January 2018.
In its arguments on Wednesday, New York said New Jersey was wrong about its ability to break the agreement.
