The Energy Regulatory Commission has imposed a P21.6-million penalty on a local power distribution company, which was also ordered to immediately refund the “unauthorized” charges it imposed on its customers from 2013 to 2022. /PDI
The regulator said no other charges were allowed under Section 2, Article 2 of the governing rules on automatic cost adjustment and true-up mechanisms and the corresponding confirmation process for distribution utilities, which are also known as OU Rules.
Sfelapco said its Apri supply was according to the ERC’s policy of allowing contract extension and implementation without the need for any further regulatory approval, provided that the rates implemented were approved by the commission. The power distributor said had it not implemented its power service agreement in accordance with the OU Rules, it would have been exposed to more expensive supply of electricity from WESM.But the ERC said the company’s arguments were flawed, adding that extensions of expired power service agreements must always be supported by a written authority from the commission.
