In Smith’s published testimony, he stated that he believes NIL is beneficial to to the “student-athlete experience,” and has been more successful for student-athletes than portrayed.
However, he expressed a number of concerns and issues with NIL that he’s become aware of. He referenced “bad actors” seeking personal gain, and the fact that athletes have asked schools for upwards of $5,000 to visit. “In worst case scenarios, student-athletes have been offered lucrative NIL “promises” that have not materialized once they arrived on campus,” Smith wrote. “In other cases, verbal NIL offers have been tendered to elite student-athletes to entice them to leave one institution and transfer to another based on a lucrative verbal NIL inducement.”
There is no federal law regarding NIL, and though various states have discussed legislation, there has not been any uniformity across the country in regards to potential legislation. “There’s over 350 Division I schools in this country,” Smith said. “And the diversity in how they’re financed is significantly different. Many of the schools that we’re blessed to have in our country to educate our children, the athletic departments are funded through the university general funds, or student fees. They’re not like Ohio State...We’re a different beast. Part of the reality is that we’re listening to comments about places that don’t do it right.
