The American Civil Liberties Union is challenging a new state law that allows police to set up a 25-foot perimeter while conducting police activity, a law that representatives from law enforcement agencies in Lake and Porter counties say they support because of the safety it provides for all involved at a crime scene.

The ACLU of Indiana is seeking a preliminary injunction of House Bill 1186 from the U.S. District Court in the Northern District of Indiana. The law took effect July 1.

“What would we have lost if there had been 25-foot barriers?” he said. “It just seems like a law that is subject to so much interpretation.” For their part, both the Lake and Porter County sheriffs say they are in support of the law. Lake County Sheriff Oscar Martinez Jr., said in an email that his office has not had any incidents of citizens violating the law since July 1.

Porter County Sheriff Jeff Balon finds the law fair and reasonable and said in a statement it can ensure a layer of safety for those observing, and privacy for those within the perimeter where police may be gathering personal information. It may also help maintain scene integrity and aid in the collection of evidence.
