Warrants are sought for Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant, and Hamas leaders Yehiya Sinwar, Mohammed Deif and Ismail Haniyeh.
The prosecutor of the International Criminal Court, Karim Khan, announced Monday that after reviewing evidence of Hamas’s Oct. 7 attacks and Israel’s subsequent war in Gaza, he requested the ICC issue arrest warrants against five top-ranking Israeli and Hamas leaders, including Israeli Prime Minister Benjamin Netanyahu. But the ultimate decision on whether to grant any of the arrest warrants rests with judges in the ICC’s Pre-Trial Chamber.
Alternatively, judges may issue a summons if they are satisfied that the person will appear voluntarily before the court, the court says. In the past, ICC judges have taken from a few weeks to several months to issue warrants. After Khan requested a warrant to be issued against Russian President Vladimir Putin on Feb. 22, 2023, judges granted the request on March 17. But it has also taken longer.
