The department in its filing did not offer a specific prescription in the case but argued that it is possible to craft an injunction blocking threatening activity consistent with the First Amendment’s protection of free speech and assembly. “It’s notable that this compelling brief was filed in such a short time frame,” following Liburdi’s decision not to intervene, Lang said.
