Todd Ashker, 59, alleged he was being retaliated against by being placed in solitary confinement for his work to end indefinite solitary throughout California prisons.
SAN FRANCISCO — A federal judge has dismissed a lawsuit by a California prisoner who helped end indefinite solitary confinement in the state penal system, ruling he’d failed to prove that he was sent to solitary confinement because of his political activism.
Alsup wrote in his order that Ashker failed to establish a “causal nexus” between his SHU term and activism, which officials justified by claiming a confidential informant had implicated Ashker in an Aryan Brotherhood gang plot to kill a doctor and two attorneys. Ashker countered that authorities in prison can get anonymous confidential informants to say anything they want because they control prisoners’ day-to-day lives.
