The ex-Trump lawyer has already been forced to pay more than $89,000 in attorneys fees in the case, but the election workers believe his punishment should go even further.

Two Georgia election workers asked a federal judge late Tuesday to impose “severe sanctions” against former Trump attorney Rudy Giuliani as part of their lawsuit accusing him of defamation for claims made after the 2020 election, arguing the lawyer should be punished after he failed to turn over evidence in the case—even after he was already forced to pay more than $89,000 in fees.Copyright 2023 The Associated Press. The election workers said communications they found through other means—like document requests to people Giuliani messaged with—suggest there are “many” records that Giuliani could turn over that would be relevant to the case, but he and his counsel failed to provide them. The motion for sanctions was filed after the plaintiffs reached an agreement with Giuliani’s counsel on the evidence, but were then informed on Monday that Giuliani “did not agree” and thus the settlement was “not achievable,” according to the court filing.to pay attorneys fees for his failure to produce evidence in the case—which the election workers have said totals $89,172.50—but the new motion asks the court to impose additional punishments against him.

Freeman and Moss asked the court to order “default judgment” against Giuliani—meaning he’d be found liable for defamation now based on his misconduct, rather than waiting for the case to finish playing out—arguing Giuliani’s “behavior has severely hampered” the plaintiffs’ ability to make their case in court, and the attorney has “disrespected” the court by ignoring his obligations to turn over evidence.

If it doesn’t decide the case now against Giuliani, the election workers said court should at least rule that Giuliani “spoilated” evidence, “acted with reckless disregard for the truth” and spread false claims about the plaintiffs for his own benefit, and the court should order Giuliani to give his devices and online accounts to the plaintiffs to inspect, or block him from using any of that evidence to defend himself.
