A juvenile magistrate on Monday agreed to release from juvenile detention a 17-year-old girl who allegedly shot and killed a young man in Union Township earlier this month.

The girl, who the Post-Tribune is not naming because of her age, will be living with her mother in Union Township under a host of restrictions set forth by Magistrate Kristen Mulligan, including testing at least twice a week for alcohol and drugs; continued treatment for mental health issues; no guns or alcohol being present in the home; and being allowed to leave the house only for school.The girl is not to have a cellphone or be allowed to drive, nor is she to have any contact with friends.

The girl’s probation officer, Julie Jozwiak, argued against the girl’s release to the custody of her mother. She didn’t have a copy of the police report, she said, and nothing had changed since a preliminary hearing in the days after the girl was taken into custody after the shooting.Both Shanahan and defense attorney Ken Elwood said the girl should be released from juvenile detention to live with her mother.

Elwood added that the person who called 911 after the shooting said the girl “didn’t do it on purpose” and didn’t know the gun was loaded, though Shanahan balked and said the hearing wasn’t meant to be evidentiary in nature.
