Federal prosecutors included these pictures of Timothy Hale-Cusanelli in 2021 court papers opposing his release from custody pending trial. In their sentencing report, prosecutors did not list all his Nazi-sympathizing beliefs, they wrote, saying theyand focused on Hale-Cusanelli as a felon who has a cavalier regard for the truth, and who took part in the “cardiac arrest” of the “beating heart of democracy.”

Hale-Cusanelli’s lawyer, Nicholas Smith, wrote that his client’s mustache was a joke resulting from New Jersey Gov. Phil Murphy imposing severe lockdowns during the coronavirus pandemic. “He shaved his mustache and struck the poses, as if to say, ‘Look at me, I’m a governor-tyrant with emergency powers.’ "
