A federal appeals court panel agreed with a judge's reason for dismissing the suit but ruled he should have permitted the filing of an amended complaint.

Carlson in May 2021 dismissed the complaint stating the estate failed to state a valid federal claim against Laura Wolfe, a certified nurse practitioner. Vorobyev’s father, Andrey of Dingman’s Ferry, who brought the suit on behalf of the estate, conceded claims against the university and commonwealth were barred.

Vorobyev gave that nurse a letter from a doctor and nurse practitioner detailing his past complications with his diabetes and setting forth signs and symptoms that, if left untreated, could lead to life-threatening diabetic ketoacidosis.
