After a nearly six-year battle in court over alleged Fair Labor and Standards Act violations, a lawsuit involving Outokumpu is close to being resolved with the
stainless steel manufacturer located in Mobile County coming out on the losing end. On Friday, a federal appeals court ruled the default judgment entered against the steel giant is valid, the only question remaining is how much they owe workers in back pay .
The court in its opinion noted that “Over the course of nearly two years, the district court ordered Outokumpu to produce the key pay, time, and incentive plan records twelve separate times.. But when the time came to comply, somehow Outokumpu always had another excuse—leaving the plaintiffs without any way to prove their case.”
