F1 has caved in to pressure from stationery giant 3M and modified the trademark filing for its own logo in order to put the brakes on a long-running legal battle.
European Intellectual Property Office records show that 3M registered a pan-European trademark to its logo in June 2017 which gave it precedence as F1 didn’t even apply for its new logo until November. In January last year wein Britain’s Daily Telegraph newspaper that 3M was considering what action to take and six months later it began to rev up.
The tussle was on track to begin in August last year as the EUIPO wrote to F1 saying that “the adversarial part of the opposition proceedings will begin on 27/08/2018.” However, five days before that, another EUIPO filing revealed that it hadn’t yet reached the final lap., according to the filing, both parties had requested “to extend the period before the start of the adversarial part of the opposition proceedings, this period has been extended by 22 months.
F1 agreed to add a disclaimer saying that in the categories which cover clothing and sporting equipment, “none of the aforementioned goods [are] intended or adapted for use in an orthopedic or therapeutic setting, for orthopedic or therapeutic muscle or joint support, or as orthopedic or therapeutic compression or anti-embolism products.”
