The Sandiganbayan on Friday convicted two former Department of Agriculture officials of graft in connection with the purchase of farm equipment worth P5 million without public bidding in 2004.

The decision said that BAC members Montilla and Bragas immediately resolved to award the contract for the purchase of the four pieces of farm equipment under the following circumstances: It added that there is no question that the duty of administering the bidding process lies with the BAC, and it is incumbent upon them to ensure that only in the proper cases should a recourse to an alternative mode of procurement be made.

"It was able to corner P5 million worth of transaction without having to abide by prevailing rules on an open and public bidding and without affording the end-user an opportunity to vet for quality and cost," the Sandiganbayan said. " . . . .For instance, we know of machines from LCV Design and Fabrication, the inventor, manufacturer, and exclusive distributor of the following:high-capacity biodegradable shredder, hammermill/sifter, compost pelletizing machine and towable truck loading shredder/chipper."
