Former San Jose Mayor Sam Liccardo has already locked in one of the two spots in the November runoff.

Low or Simitian will face former San Jose Mayor Sam Liccardo at the ballot box in November for the congressional seat representing the area from Pacifica in the north to Los Gatos in the south.. On Wednesday, the ballots swung further in his favor, and he surpassed Simitian for the first time, leading by 59 votes.
“Every vote counts, and every vote has to be counted,” Simitian said in a statement Wednesday. “That’s the nature of our process, and that’s as it should be. At this point, it’s a squeaker, and all we can do is wait for the results.” “In an election this close, the odds are actually not terrible, because there are often differences in the vote count when you do a recount,” Michelson said. “There’s gremlins in the system when it comes to scanning those ballots. Obviously, we’ve come a long way since we had chads, but even with the optical scanners sometimes the robots get it wrong and the count comes out slightly differently.”
If the results are close enough, Simitian or Low’s campaign would have to request a recount, and that could come at a hefty cost. “I think that was one of the considerations that was on the minds of the Al Gore campaign in 2000,” she said, referring to a vote count dispute during the presidential election in the swing state of Florida. “There were folks waving signs that said ‘Sore Loserman,’ making fun of the Gore-Lieberman campaign signs. You don’t want to make it look like you’re just asking for a recount because you’re being a sore loser.
