Dallas County says it will sue the state if psychiatric hospitals don’t start accepting more mentally ill inmates.

Commissioners have sent a letter telling the state it has 30 days to admit mentally ill inmates before a suit is filed.

The Dallas County jail holds 369 inmates who have been deemed to need clinical help before their trial can start, according to the county’s Wednesday jail population report. The attorney general’s office did not respond to a request for comment, and the Texas Health and Human Services Commission declined to comment.

Price and Sommerman have spearheaded county efforts to sue the state to get Texas to more quickly accept responsibility for inmates who are supposed to be in state care. Some jail inmates who are arrested for low-level offenses but need their competency restored before a trial are being released after serving the maximum potential sentence for a charge without ever getting a trial or medical care ordered by a judge at a state hospital.
