The PRESS Act is the strongest federal “shield” bill for journalists ever introduced. Not only would it stop the government from compelling journalists themselves to burn sources, but it would also bar officials from surveilling phone and email providers to find out who is talking to journalists, write Seth Stern and Gene Schaerr. It’s been a rough few weeks for former Fox and CBS journalist Catherine Herridge. First, CBS laid her off.
The reason for the bipartisanship is simple: Administrations from both parties are equally susceptible to the temptation to retaliate against journalists who embarrass them. Justice Departments under Presidentswhen Democrats went after journalist Matt Taibbi’s sources for his reporting on the “Twitter Files.
Journalist-source confidentiality isn’t about putting journalists on a pedestal – it’s about making sure they’re able to deliver important news to the public. Sources like Herridge’s often come forward at great personal and professional risk. But, under current law, journalists can’t promise them confidentiality without caveats.
The law protects confidential communications in any number of other contexts: lawyers and clients, psychiatrists and patients, even married couples. It’s not because lawyers and therapists are more important than the rest of us but because confidentiality is crucial to their ability to do their jobs, which are important for society. Same goes for journalists.
