The Comelec has finalized the disqualification of former congressman Edgar Erice from running for the House of Representatives in Caloocan City's Second District in the 2025 elections.
The Commission on Elections ( Comelec ) declared on Friday, January 3, 2024, its decision to disqualify former congressman Edgar Erice from running as a member of the House of Representatives in Caloocan City's Second District in the May 2025 elections as final and executory. In its certificate of finality, the Comelec en banc said its December 27 ruling on the case against Erice is deemed 'final and executory.
' 'In view of the foregoing, the Resolution of the Commission en Banc promulgated on 27 December 2024 is hereby declared final and executory under the Comelec Rules of Procedure, and Comelec Resolution No. 11046,' said the Comelec. It said this is due to the absence of a temporary restraining order (TRO) from the Supreme Court (SC) issued against the Comelec's ruling. Under the Comelec's Rules of Procedure, a decision or resolution of the Commission en Banc shall become final and executory after five days from receipt of the decision or resolution, unless restrained by the Supreme Court. 'Whereas, no restraining order has been issued by the Supreme Court within five days from receipt of the parties of the Resolution that would preclude the 27 December 2024 resolution of this Commission en Banc from being final and executory,' said the Comelec. In its 30-page decision, the Commission en Banc ruled to concur with the earlier decision of the Comelec Second Division to disqualify Erice owing to his public statements questioning the credibility of the automated election system of South Korean firm, Miru Systems. 'The integrity of elections is the cornerstone of democracy, and any act that undermines this foundation cannot be tolerated. Respondent's disqualification is not merely justified but necessary to protect the sanctity of our electoral process.
