CEBU CITY — The Commission on Elections (Comelec) has canceled the reelection bid of dismissed Mandaue City Mayor Jonas Cortes by canceling his Certificate of Candidacy (CoC) due to false information.A document obtained by The Manila Times on Thursday, Dec. 19, 2024, revealed that the Comelec Second Division granted the petition of lawyer Ervin Estandarte, who claimed Cortes committed a 'serious misrepresentation' in his CoC.
Estandarte alleged that Cortes falsely declared he was eligible to run for mayor and marked 'N/A' on questions about pending cases, even though the Ombudsman issued a dismissal order against him on Oct. 3, 2024, just one day before he filed his CoC. The lawyer accused Cortes of deliberately hiding this information to deceive voters.The Comelec underscored that Sections 74 and 78 of the Omnibus Election Code require candidates to truthfully declare their qualifications and provide for the cancellation of a CoC if it contains material misrepresentations.'Respondent's declaration in his CoC, which constitute his qualifications for mayor, is material and false, considering he misrepresented the fact that he is no longer qualified to run for office,' the Second Division stated.'Respondent signed his CoC and subscribed and sworn to the veracity of his declarations therein, indicating that his false representation is deliberate, and will effectively mislead the electorate on his qualification as mayor of Mandaue City, Cebu.' The ruling was signed by Presiding Commissioner Marlon Casquejo and Commissioners Rey Bulay and Nelson Celis.The Comelec also noted that under Section 40(b) of the Local Government Code, individuals dismissed from office due to administrative cases are disqualified from running for elective positions.Documents submitted by Estandarte showed that Cortes was dismissed for failing to issue a cease-and-desist order against a batching plant operating without a business permit from 2020 to 202
