Bill aimed to end 'pay-to-play' conflicts in land use but its scope will affect other decisions and alter campaign financing

The bill expanded the Levine Act, which was approved in 1982 and prohibited appointed members of boards such as planning commissions from voting on contracts or other matters if they received more than $250 in donations from a party with interest in that decision.The county’s Neighborhood Reinvestment Program allows each of the five San Diego County supervisors to make grants totaling $2 million annually to community groups and nonprofits of their choosing.
That also may keep the supervisors from having issues with SB 1439, given the actual decision will be made by county staff. Anderson notes the grants will be vetted by county lawyers and other administrators.He dismissed concerns about SB 1439, saying that both campaign contributions and grants are listed publicly and any conflict would be apparent and exposed, particularly by the news media.
“License, permit, or other entitlement for use” means “all business, professional, trade, and land use licenses and permits and all other entitlements. . .” Public employee unions and their members are exempt under the law, meaning they could still make campaign contributions and the elected officials would not be required to recuse themselves from voting or return the money.
