Breaking: Planned Parenthood and other clinics can continue to offer abortions in Utah, at least for now, a district court judge decided Tuesday.
Whether a law that bans abortion clinics in Utah goes into effect now depends on a larger question that lies with the: Is the right to an abortion protected by the Utah Constitution?
“The plaintiff has persuasively argued that ‘[t]he balance of equities and public interest ... decisively weigh in [the plaintiff’s] favor,’” wrote 3rd District Court Judge Andrew Stone — who also pulled the brake on the trigger law after Planned Parenthood Association of Utah filed a lawsuit last summer — in his order Tuesday.
The decision comes just hours before the new law — Rep. Karianne Lisonbee’s HB467, called “Abortion Changes” — was scheduled to take effect on Wednesday. Utah’s abortion trigger ban, which passed in 2020, went into effect in June 2022 after the U.S. Supreme Court overturned the landmark abortion rights case Roe v. Wade. Stone stopped it with a restraining order a few days later, and eventually with a preliminary injunction.
The state’s attorney general’s office appealed Stone’s injunction to the Utah Supreme Court, where the five justices are currently mulling what to do with the law.The second injunction issued by Stone shelves Lisonbee’s “Abortion Changes” until the Utah Supreme Court makes its decision on the earlier case. Signed by Gov.

Utah judge delays implementing statewide abortion clinic banA Utah judge has ruled that the state law banning abortion clinics cannot take effect this week as scheduled amid a lawsuit filed by the state’s largest abortion provider. Judge Andrew Stone on Tuesday granted a request from Planned Parenthood to delay implementing a law that would have stopped abortion clinics from getting licenses beginning on May 3. The organization argues the ban signed into law earlier this year will effectively end access to abortion in Utah. The ruling in the fight over lawmakers’ latest effort to restrict abortions comes less than a year after the U.S. Supreme Court overturned Roe v. Wade.
