Prosecutors tried to introduce a different motive; Oakland police Det. Gerald Moriarty testified that in the days after Glenn’s killing, police received a phone call from an anonymous tipster stating that Glenn was out for revenge over the death of his brother, who “passed away of a drug overdose.” LeGrand’s public defender objected to that portion of the testimony and Judge Thomas Reardon ordered it stricken from the record, according to a transcript of the hearing.

The case largely hinges on surveillance video footage from the Valero station. LeGrand, identified by police due to a large tattoo on his neck, is seen speaking with Glenn for about 15 minutes leading up to the shooting. LeGrand’s attorney argued in court that Glenn had texted people about how he had it out for someone he referred to as “B” over a debt, and that he appeared to be yelling at LeGrand.
