The lawsuit requests compensatory and punitive damages for mental anguish and severe emotional distress the boy suffered as a result of the assault, invasion of privacy, negligence, and recklessness.
A Limestone County school employee allegedly abused a 12-year-old non-verbal student with autism during the first months of the 2021-22 school year, a lawsuit filed Monday claims.
Patterson, her attorneys, and school system officials had not responded to requests for comment prior to publication of this story. The suit claims the boy has “never attacked another student or any teacher,” but when the boy’s mother met with Principal Louis Berry in mid-November, he allegedly told her she needed to keep her son home “because his teachers needed a break from him.”
The Limestone County Sheriff’s office investigated the aide’s actions after being notified about the alleged abuse, according to court records. According to the suit, the investigator told the boy’s mother “they had found ‘a number of red flags,’ including but not limited to a failure to report incidents to parents, DHR, or LCSO, which led to ‘a series of systematic failures.’”
