AUSTIN, Texas — Gov. Greg Abbott has found one more way to poke the Biden administration for federal inaction on the Texas-Mexico border: Suggesting a challenge to the U.S. Supreme Court opinion that requires Texas to teach all students, regardless of immigration status.

Speaker Dade Phelan and Lt. Gov. Dan Patrick have not taken positions on whether Plyler v Doe should be overturned “I think we will resurrect that case, and challenge this issue again, because the expenses are extraordinary,” Abbott said. “And the times are different than when Plyler v Doe was issued many decades ago.”

“Migrant kids didn’t ask to be brought into Texas any more than any child did: children are at the mercy of what the adults in their lives do, before and after they are born,” said Executive Director Bee Moorhead. “Instead of finding ways to withhold the education lifeline from migrant children, we should expect lawmakers to recommit to ensuring every child in this state grows up mentally, emotionally, and physically strong.
