The Texas Lottery Commission has asserted that a vodka with the same name as one of its games of chance would confuse its customers and erode its reputation.
The General Land Office appears to have been the most assertive among state agencies in seeking legal ownership of phrases recognizable to most Texans. Many are connected to the historic Alamo site, which it manages.
Federal records show the Texas Lottery Commission trademarked “Texas Two Step” in 2001 after introducing its $1 draw ticket of the same name. In recent legal filings, it has asserted that a vodka with the same name as one of its games of chance would confuse its customers and erode its reputation. A company can oppose a new applicant in a similar business even if the trademarked words or images aren’t identical. When a San Antonio company proposed opening an Alamo visitor site across the street from the real mission using the slogan “Remember … The Battle for Texas,” the General Land Office successfully argued the phrase was too similar to “Remember the Alamo.”
