Alito was right about one thing: It is time, he wrote, “to return the issue of abortion to the people’s elected representatives,” but the chances of Congress codifying Roe without breaking the filibuster are nil. This is another reminder of what is at stake, with five people capable of punishing millions for something that has been settled law since the Burger Court. For all her faults, America was always a durable experiment in running a democracy of disputatious people.
